Privacy Policy

This Privacy Policy explains how EcomVistara ("we", "our", "us") — operating at ecomvistara.in — collects, uses, discloses, and safeguards your personal information when you use our website and e-commerce consultancy services.

1.1 Information We Collect

We collect information you voluntarily provide and information gathered automatically when you use our platform:

Personal Data

Name, email, phone number, business name, GST number, and billing address.

Usage Data

IP address, browser type, pages visited, session duration, and click patterns.

Business Data

Marketplace credentials, seller account data, product listings, and sales analytics shared for consulting.

Sensitive Data

Payment information processed via secure third-party gateways. We never store card data.

02 — Terms of Service

Terms of Service

By accessing EcomVistara's website or engaging our services, you agree to be bound by these Terms. Please read them carefully before proceeding. These terms constitute a legally binding agreement between you and EcomVistara (Proprietorship / Private Limited), registered in India.

2.1 Scope of Services

EcomVistara provides e-commerce consultancy and management services including but not limited to: Amazon/Flipkart/Meesho/Myntra seller management, Shopify development, digital marketing, product photography coordination, SEO/SMO, PPC management, and inventory management.

The specific scope, deliverables, timelines, and fees are defined in your individual Service Agreement or Statement of Work (SOW). In case of any conflict, the SOW takes precedence over these general terms.

2.2 Client Obligations

  • Provide accurate business information, valid marketplace credentials, and timely access to required accounts
  • Ensure all products, listings, and business activities comply with applicable marketplace policies and Indian laws
  • Make payments as per the agreed schedule; delays beyond 15 days may result in service suspension
  • Not use EcomVistara's services for any unlawful, fraudulent, or deceptive activity
  • Maintain confidentiality of any proprietary methodologies or strategies shared during engagement
  • Promptly notify us of any changes to your business, marketplace account status, or contact information

2.3 Intellectual Property

All content on ecomvistara.in — including text, graphics, logos, tools, strategies, templates, and software — is the exclusive property of EcomVistara and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.

Client-specific deliverables (reports, ad creatives, store design) created under a paid engagement become the client's property upon full payment. Pre-existing proprietary frameworks remain EcomVistara's property.

2.4 Limitation of Liability

EcomVistara provides consultancy services and cannot guarantee specific marketplace ranking, sales growth, or revenue outcomes as these are influenced by marketplace algorithms, market conditions, and factors beyond our control.

To the maximum extent permitted by law, EcomVistara's total liability for any claim arising from our services shall not exceed the total fees paid by the client in the three months preceding the claim. We are not liable for indirect, consequential, or incidental damages including loss of profits, marketplace account suspension, or data loss resulting from factors outside our control.

2.5 Termination

Notice Period

Either party may terminate with 30 days' written notice unless the SOW specifies otherwise.

Immediate Termination

EcomVistara may terminate immediately for non-payment (15+ days overdue), breach of terms, or fraudulent activity.

Post-Termination

All outstanding payments become immediately due. Client data is returned/deleted within 30 days. Confidentiality obligations survive for 2 years.

2.6 Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall first be attempted to be resolved through mutual negotiation within 30 days. If unresolved, disputes shall be referred to arbitration under the Arbitration and Conciliation Act, 1996, with proceedings in Jaipur, Rajasthan. Courts in Jaipur shall have exclusive jurisdiction for non-arbitrable matters.


03 — Refund & Cancellation

EcomVistara's services involve substantial human effort, strategy development, and resource allocation from day one. Our refund policy is designed to be fair while reflecting the nature of professional consultancy services.

3.2 Non-Refundable Services

  • One-time setup fees, account activation charges, and onboarding costs
  • Third-party costs incurred on your behalf (marketplace fees, ad spends, photography vendor charges)
  • Completed audits, strategy reports, and research deliverables
  • Customised software development or Shopify store builds once approved and deployed
  • Services cancelled due to client non-cooperation or provision of incorrect information

3.3 Refund Process

Email billing@ecomvistara.in with your invoice number, reason for refund, and supporting documentation.

Review (3–5 Business Days)

Our accounts team reviews the request against the SOW and services rendered. You may be contacted for clarification.

Decision Communication

Approval or rejection communicated in writing with reasoning within 5 business days of complete documentation receipt.

Refund Processing (7–10 Business Days)

Approved refunds are processed to the original payment method within 7–10 business days. Bank processing times may add 2–3 additional days.

GST charged on invoices is non-refundable as it is remitted to the Government of India. Refunds will reflect the base service amount only.


04 — Data Protection

4.1 Security Measures

We implement industry-standard technical and organisational measures to protect your data:

All data transmitted via TLS 1.3. Sensitive data encrypted at rest using AES-256.

Access Control

Role-based access with MFA enforced for all staff handling client data.

Regular Backups

Automated daily backups with 30-day retention. Tested quarterly for recovery.

Audit Logging

All data access events logged with timestamps, user identity, and action type.

4.2 Data Breach Response

In the event of a data breach, EcomVistara will:

  • Contain the breach and conduct forensic investigation within 24 hours of detection
  • Notify affected clients within 72 hours, as required under DPDP Act 2023
  • Report to relevant authorities (CERT-In, Data Protection Board) as mandated by law
  • Provide a detailed incident report and remediation steps within 14 days

4.3 Cross-Border Data Transfers

Some of our cloud infrastructure and SaaS tools are hosted on servers outside India (AWS US-East, Google Cloud). All such transfers are governed by Standard Contractual Clauses (SCCs) and the service providers are compliant with the EU-India data transfer frameworks and DPDP Act provisions on cross-border transfers.

6.3 Anti-Spam & Communication Compliance

All commercial communications by EcomVistara comply with the Telecom Commercial Communications Customer Preference Regulations (TCCCP) and TRAI DLT framework. We maintain an opt-out mechanism in every marketing communication and honour opt-out requests within 10 business days.


07 — Grievance Redressal

7.3 Policy Updates

EcomVistara reserves the right to update these policies at any time. Material changes will be notified via email to registered clients at least 15 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the revised policies. We encourage you to review this page periodically.
